1. Who We Are

betk is an online gaming platform operating at betk.asia, regulated by the Philippine Amusement and Gaming Corporation (PAGCOR) and registered as a personal information controller with the National Privacy Commission (NPC) of the Philippines in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations.

For the purposes of this Privacy Policy, betk acts as the Personal Information Controller — meaning betk determines the purposes and means by which your personal data is processed. Where betk engages third-party service providers to process data on its behalf, those providers act as Personal Information Processors and are bound by data processing agreements that require them to handle your data in accordance with this Policy and applicable Philippine law.

2. Data We Collect

2.1 Information You Provide Directly

When you register an Account, complete KYC verification, make a deposit or withdrawal, contact support, or participate in promotions, betk may collect the following categories of personal data:

• Identity Data: full legal name, date of birth, gender, nationality
• Contact Data: email address, mobile number, residential address (including city, province, and postal code)
• Identity Verification Data: government-issued ID type and number, ID images, selfie photographs submitted for KYC purposes

To create and maintain your betk Account, verify your identity, process deposits and withdrawals, deliver gaming services, and provide customer support. This processing is necessary for the performance of the contract between you and betk.

4.2 Regulatory Compliance

To comply with betk's obligations under PAGCOR regulations, the Anti-Money Laundering Act (RA 9160 as amended), the Data Privacy Act (RA 10173), and other applicable Philippine laws. This includes conducting KYC verification, filing Suspicious Transaction Reports (STRs) with the AMLC where required, and maintaining records as mandated by regulators.

4.3 Fraud Prevention & Security

To detect, investigate, and prevent fraudulent activity, unauthorized Account access, bonus abuse, money laundering, and other prohibited conduct. betk uses automated systems and human review to monitor for suspicious patterns.

4.4 Responsible Gaming

To administer responsible gaming tools including deposit limits, loss limits, session controls, and self-exclusion. betk may use your gaming activity data to identify patterns that suggest problem gambling behavior and proactively reach out with responsible gaming resources.

4.5 Marketing & Promotions

With your consent, betk may send you promotional communications about new games, bonuses, and special offers via email or SMS. You may withdraw your marketing consent at any time by contacting betk support or using the unsubscribe link in any marketing email.

4.6 Platform Improvement

To analyze usage patterns, improve the betk Platform's performance and user experience, develop new features, and conduct internal research and analytics. This processing is based on betk's legitimate interest in improving its services.

5. Legal Basis for Processing

Under the Data Privacy Act of 2012, betk processes your personal data on the following legal bases:

• Contractual Necessity — processing required to perform the contract between you and betk (Account management, payment processing, game delivery).
• Legal Obligation — processing required to comply with betk's obligations under PAGCOR regulations, AMLA, and other applicable Philippine laws.
• Legitimate Interest — processing for fraud prevention, platform security, and service improvement, where betk's interests do not override your fundamental rights and freedoms.
• Consent — processing for marketing communications and certain non-essential cookies, where you have given freely given, specific, informed, and unambiguous consent. You may withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal.

6. Sharing Your Data

betk does not sell, rent, or trade your personal data to third parties for their own marketing purposes. betk may share your data with the following categories of recipients only to the extent necessary for the stated purpose:

6.1 Regulatory Authorities

PAGCOR, the Anti-Money Laundering Council (AMLC), the National Privacy Commission (NPC), and other Philippine government agencies where disclosure is required by law, court order, or regulatory directive.

6.2 Payment Processors

GCash (Mynt), Maya (Voyager Innovations), and Philippine banks (BPI, BDO, Metrobank, UnionBank, Landbank, PNB, Security Bank) for the purpose of processing deposits and withdrawals. These entities process your financial data under their own privacy policies and applicable Philippine financial regulations.

6.3 Identity Verification Providers

Third-party KYC and identity verification service providers engaged by betk to verify the authenticity of government-issued IDs and confirm player eligibility. These providers are bound by data processing agreements and may not use your data for any purpose other than identity verification on betk's behalf.

6.4 Technology & Infrastructure Providers

Cloud hosting providers, cybersecurity firms, and software vendors that support the operation of the betk Platform. All such providers are contractually required to implement appropriate technical and organizational security measures and to process data only on betk's documented instructions.

6.5 Game Content Providers

Third-party game studios and live casino operators whose games are available on the betk Platform may receive limited technical data (such as session tokens and game round IDs) necessary to deliver game content and record outcomes. These providers do not receive your identity or financial data beyond what is strictly required for game delivery.

7. Cookies & Tracking Technologies

7.1 What Are Cookies

Cookies are small text files placed on your device when you visit the betk Platform. They help betk recognize your device, remember your preferences, keep your session active, and analyze how the Platform is used. betk also uses similar technologies such as web beacons, pixel tags, and local storage objects.

7.2 Types of Cookies betk Uses

• Strictly Necessary Cookies — essential for the Platform to function. These include session authentication cookies that keep you logged in and security cookies that protect against cross-site request forgery. These cannot be disabled without breaking core Platform functionality.
• Functional Cookies — remember your preferences such as language settings, preferred game categories, and responsible gaming tool configurations.
• Analytics Cookies — collect aggregated, anonymized data about how players use the betk Platform to help betk improve performance and user experience. betk uses privacy-respecting analytics tools that do not share your data with advertising networks.

7.3 Managing Cookies

You can control non-essential cookies through your browser settings. Most modern browsers allow you to block or delete cookies. Please note that disabling certain cookies may affect the functionality of the betk Platform, including your ability to stay logged in or access certain features. betk does not use cookies for third-party advertising or behavioral profiling.

8. Data Retention

betk retains your personal data for as long as necessary to fulfill the purposes described in this Policy, subject to the following minimum retention periods required by Philippine law:

• Account and KYC records — retained for a minimum of five (5) years from the date of Account closure, as required by PAGCOR regulations and the Anti-Money Laundering Act.
• Transaction records — retained for a minimum of five (5) years from the date of each transaction, in accordance with AMLC record-keeping requirements.
• Support communications — retained for three (3) years from the date of the interaction, or longer if the communication relates to an ongoing dispute or regulatory inquiry.
• Marketing consent records — retained for the duration of your Account and for two (2) years following Account closure, to demonstrate compliance with consent requirements.
• Analytics and usage data — retained in aggregated, anonymized form indefinitely; individual-level usage data is retained for up to two (2) years.

Upon expiry of the applicable retention period, betk will securely delete or anonymize your personal data in accordance with its data disposal procedures, unless retention is required by a court order, regulatory directive, or ongoing legal proceeding.

9. Data Security

betk implements a comprehensive set of technical and organizational security measures to protect your personal data against unauthorized access, disclosure, alteration, loss, or destruction:

• Encryption in Transit: all data transmitted between your device and betk's servers is encrypted using TLS 1.2 or higher (256-bit SSL). betk enforces HTTPS across the entire Platform.
• Encryption at Rest: sensitive personal data, including identity documents and financial information, is encrypted at rest using AES-256 encryption.
• Password Security: Account passwords are hashed using industry-standard algorithms. betk never stores passwords in plain text and cannot retrieve your password — only reset it.
• Access Controls: access to personal data is restricted to betk personnel and authorized processors who have a legitimate need to access it. All access is logged and subject to regular audit.
• Two-Factor Authentication: betk offers 2FA for Player Accounts and requires it for all internal administrative access to systems containing personal data.
• Penetration Testing: betk's Platform undergoes regular security assessments and penetration testing by independent cybersecurity professionals.
• Incident Response: betk maintains a documented data breach response procedure. In the event of a personal data breach that poses a risk to your rights and freedoms, betk will notify the NPC within seventy-two (72) hours of becoming aware of the breach and will notify affected players without undue delay, as required by the Data Privacy Act.

10. Your Rights as a Data Subject

Under the Data Privacy Act of 2012 (RA 10173), you have the following rights with respect to your personal data held by betk:

• Right to Be Informed — the right to know that your personal data is being collected and processed, and to receive clear information about how it is used. This Privacy Policy fulfills betk's obligation to inform you.
• Right to Access — the right to request a copy of the personal data betk holds about you, along with information about how it is processed.
• Right to Rectification — the right to request correction of inaccurate or incomplete personal data. You can update most Account information directly through your betk Account dashboard.
• Right to Erasure or Blocking — the right to request deletion or blocking of your personal data where it is no longer necessary for the purpose for which it was collected, or where processing is unlawful. Note that this right is subject to betk's statutory record-keeping obligations.
• Right to Object — the right to object to the processing of your personal data for direct marketing purposes or where processing is based on betk's legitimate interest. You may opt out of marketing communications at any time.
• Right to Data Portability — the right to receive your personal data in a structured, commonly used, machine-readable format and to transmit it to another controller where technically feasible.
• Right to Lodge a Complaint — the right to file a complaint with the National Privacy Commission (NPC) if you believe betk has violated your data privacy rights. The NPC can be reached at privacy.gov.ph.

To exercise any of these rights, please contact betk's Data Protection Officer using the contact details in Section 14. betk will respond to all data subject requests within fifteen (15) business days of receipt, in accordance with NPC guidelines.

11. Children's Privacy

The betk Platform is strictly intended for individuals who are twenty-one (21) years of age or older, in accordance with Philippine gambling regulations. betk does not knowingly collect personal data from individuals under the age of 21.

If betk discovers or has reason to believe that an Account has been registered by a person under 21 years of age, betk will immediately suspend the Account, void any transactions, and delete the associated personal data to the extent permitted by law. If you are a parent or guardian and believe your child has registered on betk, please contact betk support immediately.

12. Cross-Border Data Transfers

betk's primary data processing infrastructure is located within the Philippines. However, certain third-party service providers engaged by betk — including cloud infrastructure providers, game content providers, and cybersecurity vendors — may process data in other jurisdictions.

Where personal data is transferred outside the Philippines, betk ensures that appropriate safeguards are in place to protect your data to a standard equivalent to that required under the Data Privacy Act of 2012. These safeguards may include:

• Standard contractual clauses approved by the NPC or equivalent data protection authority
• Binding corporate rules where the recipient is part of the same corporate group
• Transfers to jurisdictions recognized by the NPC as providing an adequate level of data protection

13. Policy Amendments

betk reserves the right to update or amend this Privacy Policy at any time to reflect changes in betk's data processing practices, applicable law, or regulatory requirements. Material changes will be communicated to registered Players via email or in-platform notification at least seven (7) days before the changes take effect.

The most current version of this Privacy Policy will always be available at betk.asia/privacy-policy. The effective date at the top of this page indicates when the current version came into force. Your continued use of the betk Platform after the effective date of any amendment constitutes your acknowledgment of the revised Policy.

If betk intends to process your personal data for a new purpose that is materially different from those described in this Policy, betk will seek your consent before doing so, where required by the Data Privacy Act.
